By creating an account or using HangarNight ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including pilots (guests) and hangar owners (hosts).
HangarNight is a marketplace that connects pilots seeking overnight hangar space with hangar owners who offer it. We are not a party to any rental agreement between hosts and guests. We provide the technology, payment processing, and trust infrastructure that makes those agreements possible.
This is one of the most important sections of this agreement. Please read it carefully.
You agree that you will not use information obtained through HangarNight to circumvent the Platform or complete transactions outside of it. Specifically, you agree that:
(a) You will not share personal contact information (including phone numbers, email addresses, social media handles, or any other identifying contact details) with another user prior to a confirmed, paid booking on HangarNight.
(b) You will not arrange, request, or accept payment for hangar stays using any method other than HangarNight's checkout system (including but not limited to cash, Venmo, CashApp, Zelle, PayPal, wire transfer, or personal check).
(c) You will not use HangarNight's messaging system to arrange or solicit transactions that bypass the Platform's booking and payment process.
(d) If you discover another user attempting to circumvent these terms, you agree to report it to HangarNight at hello@hangarmarketplace.com.
Consequences of circumvention: Violations of this section will result in immediate, permanent account termination for all involved parties. Additionally, any party found to have circumvented a transaction agrees that they owe HangarNight liquidated damages equal to three times (3×) the service fee that would have applied to the off-platform transaction. This amount represents a reasonable pre-estimate of HangarNight's damages, which are difficult to calculate precisely, and is not intended as a penalty.
HangarNight reserves the right to pursue legal action to recover these damages. By accepting these terms, you consent to personal jurisdiction in the courts of the State of Delaware for any dispute arising from a circumvention violation.
To help enforce Section 3, HangarNight's messaging system automatically detects and removes contact information (phone numbers, email addresses, URLs, and payment app references) from messages sent before a booking is confirmed. This filtering is applied in real time before messages are delivered. By using the messaging system, you acknowledge and consent to this filtering.
HangarNight's optional Booking Protection ($9.99 per booking) and all dispute resolution services are available exclusively for transactions completed through the Platform. Off-platform arrangements are ineligible for any protection, mediation, or refund services provided by HangarNight.
Protection Credit Terms. If a host cancels a confirmed booking and the guest purchased Booking Protection, HangarNight will issue a $50 account credit to the guest. This credit is subject to the following conditions:
(a) Expiry. Credits must be used within 90 days of issuance. Any unused credit balance automatically expires and is forfeited after this period.
(b) Non-stackable. Only one protection credit may be held at a time. If a guest already holds an unexpired credit, no additional credit will be issued for a subsequent host cancellation until the existing credit is used or expires.
(c) Non-transferable. Credits are tied to the account of the guest who purchased the Booking Protection and cannot be transferred, sold, or combined with other credits.
(d) No cash value. Credits have no cash value and cannot be redeemed for cash or refunds. They may only be applied toward future bookings on HangarNight.
HangarNight reserves the right to revoke credits if it determines they were obtained through fraudulent activity, including but not limited to self-dealing arrangements between related accounts.
Hosts represent that they have the legal right to rent the hangar space listed, that all information in their listing is accurate, and that the hangar will be available as described. Hosts are responsible for ensuring compliance with any airport authority regulations, lease agreements, or local ordinances that govern subletting hangar space.
Guests are responsible for ensuring their aircraft and operation comply with all applicable FAA regulations. Guests agree to leave hangar facilities in the same condition as found, and to report any damage immediately. Guests assume all risk associated with the storage of their aircraft.
HangarNight charges a service fee on each booking, which is included in the price displayed at checkout. This fee compensates HangarNight for payment processing, trust and safety infrastructure, customer support, and platform maintenance. The fee is non-refundable except as required by applicable law.
Cancellation terms are set by the host at the time of listing. HangarNight will honor the host's stated cancellation policy. In cases of documented emergency or force majeure (including significant weather events that make flight impossible), HangarNight may, at its sole discretion, issue partial or full refunds.
HangarNight is a technology marketplace and is not an airport operator, fixed-base operator (FBO), hangar owner, or aviation authority. By using the Platform, all users expressly acknowledge and agree to the following:
(a) Airport Security. Access to any airport, ramp, taxiway, hangar, or secured area is governed exclusively by the applicable airport authority, TSA regulations, local law enforcement, and any other relevant federal, state, or local authority. HangarNight has no control over, and accepts no responsibility for, security protocols, access controls, or security incidents at any airport or hangar location listed on the Platform. Hosts are solely responsible for ensuring that their listed space complies with all applicable security requirements, including but not limited to Airport Security Programs, TSA regulations (49 C.F.R. Part 1542 and related provisions), and any rules imposed by the airport authority.
(b) Aircraft Damage and Loss. HangarNight makes no representations regarding the physical security, structural integrity, or suitability of any listed hangar for the storage of any aircraft. Guests assume full and exclusive responsibility for the safety and security of their aircraft during any stay. HangarNight is not liable for theft, vandalism, weather damage, fire, flooding, structural failure, collision, or any other loss or damage to any aircraft stored at a listed location, regardless of cause.
(c) Host Liability for Security and Access. Hosts represent and warrant that they are authorized to grant access to the listed space and that doing so does not violate any airport lease, access agreement, or security directive. Hosts are solely responsible for ensuring that guests are provided with lawful access and that any access granted complies with applicable airport security requirements. HangarNight bears no liability for any unauthorized access, security breach, regulatory violation, or related consequence arising from a host's listing or a guest's access to a listed location.
(d) Regulatory Compliance. Users are solely responsible for ensuring that their use of any listed hangar space complies with all applicable FAA regulations, TSA directives, airport operating agreements, local ordinances, and any other governing rules. HangarNight does not verify, audit, or guarantee compliance with any such requirements and is not responsible for any fines, penalties, enforcement actions, or other consequences arising from a user's failure to comply.
(e) Insurance. HangarNight strongly recommends that all guests maintain adequate aircraft hull and liability insurance and that all hosts maintain appropriate property and liability coverage for their hangar space. HangarNight does not provide insurance of any kind to hosts or guests and accepts no liability for losses that could have been covered by insurance.
By using the Platform, you expressly release HangarNight, its officers, directors, employees, and agents from any and all claims, demands, or damages of any kind arising from or related to airport security, aircraft damage or loss, unauthorized access, or regulatory non-compliance at any listed location.
HangarNight is a marketplace platform. We are not responsible for the condition of any hangar, the safety of any aircraft stored therein, or any damage, loss, or injury arising from use of the Platform. To the maximum extent permitted by law, HangarNight's liability to any user is limited to the fees paid to HangarNight in the 12 months preceding the claim.
HangarNight reserves the right to update these Terms at any time. We will provide notice of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated terms.
